By accessing or using HistorIA (the “App”), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use the App.

2. Description of the Service

HistorIA allows users to:

• Scan historical monuments
• Receive monument recognition results
• Track exploration progress
• View maps, rankings, and achievements

The App is currently free to use, with optional Premium features that may be introduced.

3. Premium Access

HistorIA may offer optional Premium features through a one-time purchase.

4. Payment Processing (Premium)

Payments are processed exclusively through:

• Apple App Store
• Google Play Store

HistorIA does not directly handle, process, or store payment or billing information.

5. Premium Features

Premium features may include, but are not limited to:

• Enhanced statistics and progress tracking
• Advanced monument insights
• Additional visualizations or discovery tools
• Future Premium-only features

The exact set of Premium features may evolve over time.

6. Premium Feature Refunds

Refunds for Premium purchases are handled according to:

• Apple App Store policies
• Google Play Store policies

HistorIA cannot issue refunds directly.

7. Changes to Premium Features

HistorIA reserves the right to:

• Modify, add, or remove Premium features
• Improve or adjust Premium content over time

Such changes will not convert the one-time purchase into a subscription.

8. Optional User Feedback & Contribution

HistorIA may offer users the optional ability to contribute feedback to help improve the accuracy and quality of the App.

Feedback Features

Users may, on a voluntary basis:

• Submit textual feedback about recognition results
• Report incorrect or failed monument recognitions
• Propose missing monuments not currently present in the App
• Upload reference images, descriptions, and the approximate location of missing monuments

Participation in feedback features is entirely optional and does not affect access to the App or its features.

Use of Feedback Data

By submitting feedback, you acknowledge and agree that:

• Submitted content may be anonymized
• Personal identifiers are removed where applicable
• Feedback data (including images, descriptions, and location metadata) may be used to:
  • Improve monument recognition accuracy
  • Train, validate, and evaluate computer vision (CV) and machine learning models
  • Enhance monument databases and discovery features

Feedback data is used solely for research, improvement, and operational purposes related to HistorIA.

You retain ownership of the content you submit, while granting HistorIA a non-exclusive, royalty-free license to use such content for the purposes described above.

9. Donations

HistorIA may offer users the option to make voluntary donations to support maintenance, development, and operational costs.

Donations:

• Are entirely optional
• Do not unlock features
• Do not provide Premium access
• Do not affect app functionality, rankings, or visibility

10. Nature of Donations

By making a donation, you acknowledge that:

• Donations are not payments for goods or services
• Donations do not create any contractual obligation
• Donations do not guarantee new features or updates

Donations are a way to support the project, not a purchase.

11. Donation Payment Processing

Donations are processed through:

• Apple App Store
• Google Play Store

HistorIA does not store or process payment details directly.

12. Donation Refunds

Donations are generally non-refundable, except where required by:

• Apple App Store policies
• Google Play Store policies
• Applicable law

Any refund requests must be handled through the relevant app store.

13. No Advantage or Preference

Users who choose to donate:

• Receive no competitive, ranking, or functional advantage
• Are treated equally to non-donating users

14. Changes to Donation Options

HistorIA reserves the right to:

• Modify available donation amounts
• Add or remove donation options
• Disable donations at any time

15. No Guarantee of Lifetime Service

The one-time Premium purchase grants access to Premium features for as long as the App and its services are operational.

HistorIA does not guarantee uninterrupted or indefinite availability of the App.

16. Taxes

Prices include applicable taxes unless otherwise stated by the App Store or Google Play Store.

17. User Accounts

• Users are responsible for maintaining the security of their account
• You must provide accurate information
• You are responsible for all activity under your account

18. User Content

• Users may upload images for monument recognition
• You retain ownership of your images
• By uploading images, you grant HistorIA a temporary, non-exclusive license to process them solely for App functionality
• Uploaded images used for recognition are not stored permanently, unless explicitly submitted as feedback

19. Acceptable Use

You agree not to:

• Use the App for unlawful purposes
• Upload offensive, illegal, or abusive content
• Attempt to reverse-engineer or disrupt the service
• Abuse rankings, feedback systems, or scanning mechanisms

20. Intellectual Property

• The App, its design, branding, and code are the property of HistorIA
• Monument data, descriptions, and progression systems are protected by applicable laws
• You may not copy or redistribute content without permission

21. Disclaimer

HistorIA provides monument recognition and information for educational and entertainment purposes only.

Recognition results may be inaccurate or incomplete. No guarantee is made regarding correctness or completeness.

22. Limitation of Liability

To the maximum extent permitted by law:

• HistorIA is provided “as is”
• We are not liable for indirect, incidental, or consequential damages
• Use of the App is at your own risk

23. Termination

We reserve the right to suspend or terminate accounts that violate these Terms.

Users may stop using the App at any time.

24. Governing Law

These Terms are governed by the laws of Italy and applicable European Union regulations.
